1. DEFINITIONS
1.1 “Buyer means the individual or organisation who buys or agrees to buy the Goods from the Seller;
1.2 “Consumer” shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;
1.3 “Contract” means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these terms and conditions;
1.4 “Goods” means the articles that the Buyer agrees to buy from the Seller;

2. CONDITIONS
2.1 Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.
2.2 These Terms and Conditions shall apply to all contacts of sale of goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
2.3 Acceptance of delivery of the Goods shall be deemed conclusive of the Buyer’s acceptance of Terms and Conditions.
2.4 Any variation to these Terms and Conditions (including any special Terms and Conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

3. ORDERING
3.1 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason

4. PRODUCT
4.1 All Products are subject to availability. In the event of any supply difficulties, the Seller reserves the right to substitute Product of equivalent value and quantity without notice.
4.2 In the event that we are unable to supply the Product selected by the Buyer or any substitute Product selected by the Buyer or any substitute product, we shall notify you as soon as is reasonably possible and shall reimburse your payment in full and in any event no later than 30 days after the intended delivery date.

5. PRICE AND PAYMENT
5.1 The Price of the Goods shall be that stipulated on the Seller’s Website. The Price is inclusive of VAT. A service and relay charge may be applied depending on the product, delivery location and delivery date specified.
5.2 The total purchase price, including VAT and delivery charges, if any, will be displayed in the Buyer’s shopping cart prior to confirming order.
5.3 Payment of the Price including any VAT and delivery charges must be made in full before dispatch of the Goods.

6. RIGHTS OF SELLER
6.1 The Seller reserves the right to adjust the price and specification of any item on the Website at its discretion.
6.2 The Seller reserves the right to withdraw any goods from the Website at any time.
6.3 The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.

7. AGE OF CONSENT
7.1 Where Goods may only be purchased by persons of age 18 years of age the Buyer will be asked when placing an order to declare that they are of appropriate legal age to purchase the Goods.
7.2 If the Seller discovers that the Buyer is not legally entitled to order Goods, the Seller shall be entitled to cancel the order immediately, without notice.

8. WARRANTY
8.1 The Seller warrants that the Goods will at the time of dispatch correspond to the description given by the Seller on the website, or a substitute Product of equivalent value and quantity. Except where the Buyer is dealing as a Consumer, all other warranties, conditions, or terms relating to fitness purpose, merchantability or condition of Goods, whether implied by Statute, common law or otherwise are excluded, and the Buyer is satisfied as to the suitability of the Goods for the Buyer’s purpose.

9. DELIVERY
9.1 Goods will normally be delivered within the number of working days specified within the product description after receipt of the order from the Buyer. Any and all exceptions to this are listed within ‘the Delivery’ section of the Sellers website.
9.2 Incorrect personal details may lead to problems or delays in delivery, so before placing your order, please ensure that you have included the full address details, including accurate postcode of the delivery address and your daytime contact telephone number and e-mail address so that we can notify you in the event that any delivery problems are encountered.
9.3 The Seller shall use its reasonable endeavours to meet any date agreed for delivery. In any event time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.
9.4 Delivery of the Goods shall be made to the Buyer’s address and recipient in the order and the Buyer shall make all the arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. A delivery is interpreted by the Seller as ‘a delivery attempted by us or our selected couriers at the delivery address specified by the Buyer’, we do not accept any liability for any delay to delivery caused by the absences of the designated recipient to receive the goods at the specified address. If the recipient is not at the address you have requested, our courier will leave a calling card with a telephone number for the recipient to call, so that redelivery can be arranged. Goods cannot be delivered without signature from the recipient.
9.5 Title and risk of Goods shall pass to the Buyer upon delivery of the Goods

10. CANCELLATION AND RETURN
10.1 Orders may be amended or cancelled before 4pm on day of sale, or Next working day if Order is placed on weekend or Bank holiday.
10.2 To amend or cancel your order, please contact Disposable-partyware.com from 9am until 4pm Monday to Friday using the contact details set out in 8.2
10.3 The Buyer shall inspect the Goods immediately upon receipt and Shall notify the Seller by calling 01922 616608 or emailing info@disposable-partyware.com within 3 working days of Delivery of if the Goods are damaged or do not comply with any of the contract. If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods.
10.4 Where a claim of defect or damage is made the Goods shall be returned by the Buyer to the Seller. The Buyer shall be entitled to full refund (including delivery costs) plus any return postage charges if the goods are in fact defective.
10.5 If you are the consumer you have the right, in addition to other rights, to cancel the Contract and receive a refund by informing the Seller using the contact details set out in section 8.2 within 3 working days of receipt of goods.
10.6 Goods must be returned by the Buyer and should be adequately insured during journey. The Buyer will receive a refund of all monies paid for the Goods (excluding delivery charges, if, any and postal charges) within 30 days of cancellation. However, if the Buyer fails to return the Goods following cancellation, the Seller shall be entitled to deduct the cost of recovering the Goods from the Buyer.
10.7 Goods to be returned must clearly show the order number obtained from the Seller on the order reference number on the invoice.
10.8 Where the returned Goods are found to be damaged due to the Buyer’s fault the Buyer will be liable for the cost of remedying such damage.

11. LIMITATION OF LIABILITY
11.1 Except as may be implied by law where the Buyer is dealing as a consumer, in the event of any such breach of these Terms and Conditions by the Seller, the remedies of the Buyer shall exceed to damages which shall in no circumstances exceed the Price of the Goods and the Seller shall in no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.
11.2 Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from negligence of the Seller or that of the Seller’s agents or employees.

12. WAIVER
12.1 No waiver by the Seller (whether express or implied) in enforcing any rights under this contract shall prejudice its rights to do so in the future.

13. FORCE MAJEURE
The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.

14. ERRORS AND OMISSIONS
14.1 disposable-partyware.com makes every effort to ensure that all prices and descriptions quoted in its catalogue and on its website are correct and accurate. However, the frenetic tempo of e-commerce makes it inevitable that mistakes will occasionally occur. In the case of a manifest error or omission, Dispsoable-Partyware.com will be entitled to rescind the contract, notwithstanding that it has already accepted the Buyers order, and Dispsoable-Partyware.com 's liability in that event will be limited to the return of any money the Buyer has paid in respect of that order.
14.2 A ‘manifest error’, as a term is used in sub-paragraph (14.1) above, means, in relation to an incorrect price, a price quoted in error by Dispsoable-Partyware.com which is more than 10% less than the price that would have been quoted had the mistake not been made.

15. SEVERANCE
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

16. CHANGES TO TERMS AND CONDITIONS
The Seller shall be entitled to alter these Terms and Conditions at any time. But this right shall not be affecting the existing Terms and Conditions accepted by the Buyer upon making a purchase.

17. GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the Laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

Making A Purchase Making a purchase could not be easier. Just browse our Catalog, and click on any items that you wish to buy and put them into the shopping cart. After you have finished your selection, click on "Order" and you will be asked for a few details that we need to be able to satisfy the order.

We accept credit/debit card payment through Protx or you can phone (01922 616608) with your card details. You can also send us a cheque, payable to Narita Limited. We use Protx as our agent to collect payments on our behalf. Protx is a very popular and reputable organisation.

If you are shopping from North America or anywhere else, place your order and your credit card company will convert the transaction to US Dollars or your own currency.

We accept most cards Visa and Mastercard and so on. We do not charge for any item until it is ready to ship. Backordered items are not charged until they are shipped. You may send your credit card information via phone, fax, snail mail or over the Internet.

If you cancel your order after paying an administration fee of £2.00 will be charged.

Shipping And Handling We charge a fixed fee of £7.00 inluding VAT for Shipping & handling.. (No deliveries weekends or Bank Holidays).

For guaranteed next day delivery add £5.00 ( including VAT) to the delivery charges.

For Saturday deliveries there is surcharge of £15.00 from the couriers and we have to pass it on to the customer.

Orders from the Ireland and offshore UK islands cost more to send. The delivery prices are sent by e-mail after receiving the order depending upon the size of the order.

Delivery Schedule We use Fedex to deliver our parcels. They will deliver upto 5 pm on the delivery day. Although Royal mail is used for smaller & lighter items. We try to deliver next day(not guaranteed) depending on the time of day the order is placed. But it can take 2-3 days normal delivery.

Orders place by Wednesday can be delivered by friday.

Orders placed on Friday are despatched on Monday. Saturday delivery charges can be requested over the phone/email. These are higher than the Monday-Friday charges.

Tax Charges For orders made from the UK or the European Union, 17.5% VAT is added( already included in the price). All other orders are VAT free and you should click the exempt button to reduce VAT to zero .

Credit Card Security All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site.
